Overview

What is EAP Legal Support?

Legal Support gives employees confidential access to qualified legal professionals who provide practical guidance on everyday legal matters, helping them understand their legal rights, explore available options and take informed next steps.

Through Converge’s Employee Assistance Program (EAP), employees can receive general legal guidance on matters such as family law, wills and estates, tenancy, property, consumer rights, insurance and traffic matters. Where ongoing legal representation is required, employees are referred to appropriate external legal services. By reducing uncertainty and legal-related stress, Legal Support helps protect employee wellbeing, confidence and workplace performance.

How does EAP Legal Support work?

When employees access our EAP legal services, they receive independent, practical guidance tailored to help them navigate their legal concerns. And chiefly, this service provides the resources and insights necessary to take informed next steps.

Our legal support appointments are easy to book via the Converge App and our online booking engine. When you engage with Converge, your employees will have swift access to all our services. Here is a step-by-step guide on how an appointment may operate:

Step 1

Employee contacts Converge and books an appointment with a qualified legal professional.

Step 2

The session provides information about rights, options and next steps.

Step 3

Follow-up resources are shared if required.

Step 4

Employee is referred to external legal services if ongoing support is needed.

EAP Legal Support vs Hiring a Private Lawyer

Not every legal matter requires formal legal representation. Converge’s EAP Legal Support is designed to help employees understand their rights, explore their options and decide on appropriate next steps. If a matter becomes complex or requires ongoing legal representation, employees can then engage a private lawyer with greater confidence and understanding.

For many employees, EAP Legal Support is the ideal first step. It provides practical guidance, helps reduce uncertainty and enables employees to make informed decisions before engaging a private lawyer if further legal assistance is required. By combining confidential legal guidance with referrals where appropriate, Converge helps employees access the right level of support at the right time.

What Legal Matters Can EAP Support With?

Our EAP legal services provide general guidance to employees to help them better understand their rights and next steps when faced with legal issues. Our lawyers will also signpost employees to documentation and templates, and refer them to external legal support if a long-term solution is required. The goal of our EAP legal advice sessions is to help employees feel comfortable and informed regarding their legal issue, and to provide information and guidance on their next steps and ways to resolve any dispute. Here is a range of matters our EAP legal advice covers:

  • Family law matters, including property division and parenting arrangements
  • Wills, estate planning, power of attorneys, and contested estates
  • Tenancy and rental issues
  • Real estate and property issues
  • Consumer rights
  • Criminal and traffic law
  • Insurance-related matters
  • Other everyday legal challenges
  • Legal support for employees when staff are considering raising a legal dispute (exception is employment disputes due to conflict of interest)

Support from our EAP legal services stream is generalist in nature. Unfortunately, our team cannot support with workplace employment law or any matter that could be a conflict of interest, and they are unable to sign or certify any documentation, such as a will. In addition, they cannot support employees raising a legal challenge against their employer.

If an employee is involved in a criminal matter, our team can provide information and support; however, the legal information for employees will be general and not specific to the state in which they reside. While there are strict boundaries, the support our legal team provides is crucial for employees, so let’s explore the benefits of our EAP legal advice services.

There is a clear correlation  between mental health and legal issues, the Victorian Law Foundation reports. When someone faces a legal dispute, it can be highly stressful and anxiety-inducing. Not to mention, legal matters can be daunting, especially when they intersect with personal and workplace stress. Equally, the legal landscape can be highly confusing. If we’re not lawyers or part of the legal profession, the jargon can feel overwhelming.

At Converge, we understand the complexities your employees may face and offer EAP legal advice services that help clarify legal rights and available options. This service provides valuable guidance in key areas, empowering your team to make informed decisions. Sometimes, we need a guiding hand deciphering legal terminology and content and our lawyers are on hand to support your employees with their legal matters.

Our EAP legal service will explain the context and legal requirements for each issue and provide a referral to specialised support if required. Converge’s EAP legal support does not provide formal legal representation. Instead, employees receive practical legal guidance, information and referrals where ongoing specialist support is required.

When Should Employees Use EAP Legal Support?

Employees should consider EAP legal support whenever an everyday legal issue is causing stress, uncertainty or making it difficult to know what to do next. Early legal guidance can help employees understand their rights, explore available options and make informed decisions before legal concerns begin to affect their wellbeing, relationships or work.

Legal action, whether raised against a person or a person raising it against another, is both stressful and anxiety-provoking. It’s not an enjoyable experience. Legal action almost always arises due to an adverse outcome or situation. As a result, there are usually:

Employees may experience maladaptive strategies of avoidance and escapism; for example, addictive behaviours. There can be significant repercussions of legal issues on a person’s work life: distraction, loss of productivity, increased agitation, exhaustion and burnout. Help your staff when they’re facing litigation with expert legal advice for employees from our legal professionals.

01 | Financial pressure and legal costs

02 | Anticipatory anxiety and uncertainty

03 | Feeling a loss of control

04 | Prolonged legal proceedings

05 | Relationship and family challenges

Legal issues can contribute to distraction, reduced productivity, exhaustion and burnout. Some employees may also develop maladaptive strategies of avoidance and escapism, for example, addictive behaviours. Access to confidential EAP legal support helps employees gain clarity, understand their next steps and reduce the uncertainty that often accompanies legal matters.

No. To avoid conflict of interest, EAP legal services cannot assist with employment law disputes or any matter raised against the employee’s employer. However, employees can still access support for everyday legal concerns affecting wellbeing.

How does the EAP legal support process work?

Where required, employees are referred to external legal services for continued support.

How do legal issues impact mental health and wellbeing?
